On April 26, West Virginia Governor Jim Justice signed The West Virginia Safer Workplaces Act into law. It represents a complete overhaul of private sector drug testing programs in the state. It is critical that West Virginia employers prepare for this act NOW, before the law takes effect on July 7.
The Safer Workplaces Act permits employers to conduct drug and alcohol testing of employees and prospective employees; however, the act requires strict compliance from employers who wish to take advantage of the new statute’s benefits.
Some of the issues that will be addressed during the webcast include:
- Mandatory written policy distributed to employees and potential employees
- Sample collection
- The employee’s right to request a split sample test
- Reasons for the testing program
- Potential consequences for positive tests or refusal to submit to a test
